Welcome to Gas, a service provided by Sheetz, Inc. These Terms & Conditions govern your use of the Gas website located at https://gas.sheetz.us and all associated services, tools, and features (collectively, the “Service”). By accessing or using the Service, you agree to comply with and be bound by these Terms. If you do not agree, please do not use the Service.

SHEETZ, INC. DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SHEETZ, INC. DISCLAIMS ALL LIABILITY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnification

You agree to indemnify, defend, and hold harmless Sheetz, Inc., its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses (including reasonable attorneys’ fees), arising from or related to: (i) your violation of these Terms; (ii) your use of the Service; or (iii) your violation of any third-party rights.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Allegheny County, Pennsylvania.
